There are two forms that are required to petition a personal bankruptcy in England and Wales. This is normally done in person at your local County Court or High Court if you live in London and are in its jurisdiction. It should be noted that most courts require 3 copies of both forms (this amounts to about 100 pages).

The forms required are 6.27 and 6.28 and you can download them from here - Insolvency Service website

There is an additional form (EX160), that you can download, if you are applying for the court fee remission. This is where you can apply for a discount in the overall court fee if you are on certain benefits or meet low income criteria.

Bankruptcy forms UK - Form 6.27 ‘Debtor’s Bankruptcy Petition’

This is a short form that you can download and is quite technical as you have to cross out all irrelevant sections. You list your full name, address and occupation and former addresses that you may have debt from (this is normally all addresses you have lived at in the past 5 years). There are also other sections that need to be checked for example if you have been in an IVA (Individual Voluntary Arragement).

Bankruptcy forms UK - Form 6.28 ‘Statement of Affairs’

This is a very comprehensive document that you can download of around 30 pages where you have to disclose your full financial affairs and includes information about assets (i.e. Property, vehicle etc), a detailed list of your creditors and your income and expenditure.

It is a legal court document and extremely important to complete it correctly and comprehensively so that it is suitable to be presented to the judge. A bankruptcy clerk would review this with you before it is signed and will be rejected if not completed properly.  

A very important section relates to your income and expenditure. This is because the Official Receiver will look at what surplus income you have with a view to seeking an Income Payments Agreement (IPA). This is where you may be expected to pay an amount each month for 3 years. This money goes towards repaying your creditors if the Official Receiver believes you can afford it. Note: Although your listed expenditure is considered, it may not be accepted as there are guidelines that the Insolvency Service uses.

This means that it is well worth seeking advice about the process. You can get a certain amount of free help from organisations like the Citizens Advice Bureau about the bankruptcy forms or you may choose to get professional help.
